Jury orders Hyundai to pay $249M for fatal accident with Tiburon
Justin King leftlanenews.com A Montana jury has ordered Hyundai to pay $240 million in damages over a Tiburon accident that killed three people.
The families of two cousins, 14-year-old passenger Tanner Olson and 19-year-old driver Trevor Olson, filed the lawsuit after the teenagers were killed when the 2005 Tiburon they were riding in veered into oncoming traffic.
Plaintiffs blamed the accident on a defective steering knuckle, however Hyundai's attorneys argued that the teenagers were lighting fireworks in the car immediately before the accident and the steering-knuckle damage was likely caused by the accident itself. Montana Highway Patrol found no evidence that fireworks had been ignited in the car, however, and the jury sided with the families.
After a two-week trial, jurors awarded the families approximately $8.6 million in actual damages for lost earnings. The company was then ordered to pay an additional $240 million in punitive damages.
Hyundai claims the punitive damage award is "outrageous and should be overturned," more than tripling the damage amount sought by the plaintiffs and far exceeding the $10 million limit on such awards in the state, according to a statement provided to the AP.
The Korean automaker plans to appeal the ruling.
